THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 17268 of 2008 O R D E R :

This Writ Petition has been filed seeking a mandamus to declare the action of the respondents in taking away the property of the petitioner i.e. land admeasuring Acs.11.07 guntas in Survey No. 33/A & B of Kandlakoya Village, Medchal Mandal, Ranga Reddy District, without following the procedure contemplated under the Land Acquisition Act, as illegal and arbitrary. Sri Srinivas Polavarapu, learned counsel for the petitioner has circulated the letter dated 05.02.2018 to the Registry to list the Writ Petition under the caption 'for withdrawal', enclosing the letter addressed by his client dated 19.01.2018, wherein it has been stated as under:

" We would like to approach Commissioner, Survey Settlements & Land Records to change the Classification of Sy. No. 33, Kandlakoya Village, from "Shikamkunta" to "Patta". In view of the matter request to Commissioner, Survey Settlements & Land Records and there is likelihood of getting favourable orders.

We request you Sir, to withdraw the said "W.P. No. 17268 of 2008 as in so far as our claims are concerned granting liberty to us to file a separate writ petition if Commissioner, Survey Settlements & Land Records rejects our request. Kindly take necessary steps for withdrawing the said W.P.No. 17268/2008 insofar as our claims are concerned."

In the light of the request made by the petitioner, the Writ Petition is dismissed as withdrawn with liberty to the petitioner to file a separate Writ Petition if Commissioner, Survey Settlements & Land Records rejects his request to change the classification of

Survey No. 33, Kandlakoya Village from "Shikamkunta" to "Patta". No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
