The present writ petition is filed seeking a direction to the second respondent to receive the fee paid by the petitioner for the purpose of writing BUMS (Bachelor of Unani Medical Science) Third Year Final Examination, scheduled to be held with effect from 14.11.2019. Heard Sri Zulfaquar Alam, learned counsel for the petitioner, Sri A.Prabhakar Rao, learned standing counsel appearing for the second respondent-University, and learned Government Pleader for Medical and Health.
Sri A.Prabhakar Rao, learned standing counsel for the second respondent-University, would submit that initially the petitioner had joined in the third respondent-College, and on account of cancellation of the recognition of the said College, in order to protect the interests of the students, all the students were transferred and were directed to report in the fourth respondent-College. Upon such transfer, the petitioner is required to pay the tuition fee in addition to the examination fee to appear for the examinations. Learned standing counsel would further submit that, if the petitioner pays the tuition fee and the examination fee, the second respondent-University would have no objection for issuing the hall ticket to enable the petitioner to appear for the examinations as sought.
Having regard to the aforestated submission, the second respondent-University is hereby directed to issue hall ticket to the petitioner, in the event the petitioner pays the examination fee as well as the tuition fee, to the authority concerned, by the end of college hours on 13.11.2019.
The writ petition is accordingly disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
