HONOURABLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.18450 OF 2012 O R D E R :

This writ petition is filed declaring the action of the 1st respondent-Chairman, A.P. Social Welfare Residential Educational Institutions society, Hyderabad in not passing orders on the review petition filed by the petitioner on 11.06.2012, as illegal and arbitrary and for a direction to the respondents to allow the petitioner during the transfer counselling schedule to be conducted on 26.06.2012 and consider his case as TGT, bio-Science in any one of the vacancies in Zone IV i.e., at C Belagal, Jupadubangla, Veldurthy or Dhone in Kurnool District.

This Court on 25.06.2012 at the time of admission granted interim order which reads as follows:

"There shall be a direction to the respondents to allow the petitioner to participate during the transfer counselling to be held on 26.06.2012, as the petitioner's case appears to be a genuine one based on the ground that his spouse is working elsewhere"

Counter affidavit is filed by the 2nd respondent stating that in pursuance to the interim order passed by this Court, the petitioner has attended the counselling and requested to post him in any of the institution either at APSWRS/JC, C.Belgal or APSWR School, Dhone or any other school in Kurnool District on spouse grounds. It is stated that the request of the petitioner was examined and not considered as one G.N.Sunkanna was the first person on the merit list and comes under 4th category and therefore he was posted to APSWRS/JC, C.Belfal, Kurnool District as per Rules. The

petitioner's request for girls schools was also rejected on the ground that he is below 50 years and as per the transfer guidelines, the male teacher below 50 years should not be posted to girls institutions. The Review petition filed by the petitioner was also disposed of vide proceedings dated 18.08.2012. In view of the above, it is clear that the petitioner was allowed to participate in the counselling and the review petition filed by him is also disposed of vide proceedings dated 18.08.2012, which are the relief sought by him in the writ petition.

In view of the same, nothing survives for adjudication in the writ petition and accordingly, it is dismissed as infructuous. No costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
