THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.41077 of 2016 ORDER:
This writ petition under Article 226 of Constitution of India is filed seeking to declare the registering of FIR No.137 of 2016, dated 16.11.2016, and calling the petitioner to the police station to get marry and making threat of arrest even the petitioner is not guilty of the offences, as illegal and arbitrary and consequently direct the 3rd respondent not to make threat of arrest in FIR No.137 of 2016, dated 16.11.2016.
The grievance of the petitioner is that Kumari Anatharam Swetha, who is the de facto complainant, lodged a complaint against the petitioner alleging that the petitioner and the de facto complainant are in love for the last five years and believing her that the petitioner would marry her, the petitioner enjoyed her physically and since the last three months, the petitioner along with A-3 to A-7, threatening the de facto complainant. The grievance of the petitioner is that since the petitioner is a Government employee and he is likely to compromise with the issue and if the petitioner is arrested, his career would be disturbed. Considering the grievance of the petitioner, the 3rd respondent is directed to complete the investigation in FIR No.137 of 2016 as expeditiously as possible and file a final report, if any, either way in accordance with law, without arresting the petitioner. Accordingly, the Writ Petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. ___________________ RAJA ELANGO,J Date: 25th November, 2016 KL
