THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CRIMINAL PETITION No.1229 of 2017 ORDER:

The request in the present petition filed under Section 482 of the Code of Criminal Procedure is to relax the condition of the petitioner reporting before the Investigating Officer twice in a week i.e., on every Sunday and Wednesday between 10.00 a.m. and 11.00 a.m. till charge sheet is filed, imposed by the learned Special Judge for Economic Offences-cum-VIII Additional Metropolitan Sessions Judge, Hyderabad, while granting bail to the petitioner on 25.11.2016 in Crl.M.P.No.3348 of 2016 in Crime No.228 of 2016 of P.S.Hussaini Alam, Hyderabad.

Sri C.Hari Preeth, learned counsel for the petitioner, would draw the attention of this Court to the order dated 02.01.2017 in Criminal Petition No.17342 of 2016 passed by a learned Single Judge of this Court, whereby a similar condition imposed by the very same Court against Accused Nos.7 and 8 in the very same crime was relaxed and, therefore, requests that a similar order may be passed in this petition also.

A perusal of the order dated 02.01.2017 shows that similar condition imposed against accused Nos.7 and 8 was relaxed and, therefore, the petitioner herein cannot be singled out and similar order can be passed in this petition also.

Hence, the condition of the petitioner reporting before the Investigating Officer on every Sunday and Wednesday between 10.00 a.m. and 11.00 a.m. till charge sheet is filed, imposed in the order dated 25.11.2016 in Crl.M.P.No.3348 of 2016 in Crime No.228 of 2016 by the Special Judge for Economic Offences at Hyderabad, is hereby relaxed and the Criminal Petition is accordingly allowed. Miscellaneous Petitions, if any, pending in this petition, shall stand closed.
