HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.24725 of 2019 ORDER:
This writ petition is being disposed of at the stage of admission with the consent of both the parties.
This writ petition is filed seeking a Writ of Mandamus declaring the inaction of respondents 1 to 3 in considering the representation made by petitioner No.1 on 21.08.2019 for appointment on compassionate ground, as arbitrary, illegal and violative of principles of natural justice and sought a consequential direction directing the respondents to consider the representation of petitioner No.1 and pass appropriate orders in accordance with law.
Heard both sides.
It has been contended by the 1st petitioner that her mother was employed as Secondary Grade Teacher with the respondents and she had expired while discharging her duties, on 03.02.2013. Later, petitioners have submitted a representation on 21.08.2019 seeking to consider the case of 1st petitioner for compassionate appointment, but so far, the respondents have not disposed of the said representation nor considered the case of 1st petitioner for compassionate appointment. Therefore, counsel for petitioners contend that appropriate orders be passed in the writ petition directing the respondents to consider the representation made by the petitioners and pass appropriate orders thereon. The Government Pleader appearing for respondents has contended that since the petitioners' representation is pending with the respondents,
the respondents would consider the same and pass appropriate orders within a reasonable period of time.
This Court, having considered the rival submissions made by the parties, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representation made by the petitioners on 21.08.2019 and pass appropriate orders in accordance with law within Eight weeks from the date of receipt of a copy of this order. With the above direction, the writ petition is disposed of. No order as to costs.
