Masampally Mallaiah, v. The State Of Telangana, Rep. By Its Principal Secretary,
THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.36417 of 2015 ORDER:
Petitioners claim to be the assignees of various extents of lands in Survey No.28/1 of Jukal Village, Narayankhed Mandal, Medak District and they allege that without notice to them, their assigned lands are being allotted to market yard by respondent No.4 and there is likelihood of their dispossession. Hence, they filed the present writ petition.
2. Learned Government Pleader for Revenue (Telangana) appearing for the respondents, on instructions, submitted that the petitioners are assignees of land in Sy.No.28/1; that the land in Sy.No.28/1 is Gairan Government land having Ac.275.00 gts. out of which, Ac.153.30 gts. were assigned to 87 beneficiaries and the remaining balance of land is Ac.121.10 guntas, which is unfit for cultivation, and only out of that land, Ac.5.00 gts. are allotted for market yard, and that the allegation of forcibly trying to dispossess the petitioners from their respective lands is denied.
3. It is evident from the above that the petitioners' lands are neither disturbed nor there is any interference by the revenue authorities and only out of the remaining land, which is uncultivable, Ac.5.00 gts is allotted for the market yard. Since there is no interference by the respondent authorities and there is no disturbance to the assigned lands of the petitioners, no further directions are called for.
4. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
5. Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed. ______________________________________ JUSTICE VILAS V.AFZULPURKAR
