THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN CONTEMPT CASE No.278 of 2014 ORDER:
The order, violation of which is alleged in this Contempt Case, is the order passed in W.P.No.33631 of 2013 dated 25.11.2013. The said order required respondents 3 and 4 to examine the petitioner's apprehension of threat to his life at the earliest, in any event not later than one week from the date of receipt of a copy of this order, and to take action in accordance with law.
While the order is said to have been received by the respondents on 25.11.2013, it is their case that, even prior thereto, the petitioner's request for police protection was rejected by order dated 05.10.2013; there was a delay in communicating the order; and the said order was eventually communicated on 29.03.2014. As the petitioner's request for police protection was considered and rejected by them, the respondents cannot be said to have violated the order of this Court much less wilfully and deliberately. I see no reason, therefore, to proceed against the respondents under the Contempt of Courts Act, 1971. The Contempt Case is, accordingly, closed. Miscellaneous petitions pending, if any, shall also stand closed. There shall be no order as to costs.
