Heard the learned counsel for petitioner, the learned Additional Public Prosecutor representing the respondent No.1-State and perused the entire material on record.

From perusal of the material, this Court is not inclined to quash the proceedings in C.C.No.296 of 2017 on the file of the learned III Metropolitan Magistrate at Visakhapatnam, Andhra Pradesh, but for left open all the defences. From the difficulty expressed to travel and face trial by physical presence for every adjournment from Punjab, liberty is given to the petitioner-accused by virtue of this order to file application under Section 205 Cr.P.C. before the learned Metropolitan Magistrate concerned, to permit with necessary conditions to report and to appear as and when directed in future, so that the trial will not be hampered.

Accordingly, this Criminal Petition is disposed of.
