O R D E R
The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit the petitioners prays that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the 4th respondent in repeatedly insisting the petitioner to settle the civil disputes with the 5th respondent otherwise implicate we in the false cases, is illegal, irregular, arbitrary and without jurisdiction, violative provisions of The Andhra Pradesh Pawn Brokers Act, 2002 and rules framed thereunder and offend Articles 14, 21 and 300A of Constitution of India and consequently direct the 4th respondent to take appropriate necessary action against the illegal demands made by the 5th respondent and not to interfere in any manner with civil dispute of the petitioner between the 5th respondent and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case."
The Sub Inspector of Police, Bestavaripeta Police Station, Prakasam, filed a counter affidavit denying the allegation of the petitioner that there was any insistence by the police authorities to settle his civil dispute with the fifth respondent. He also denied the allegation that the petitioner was threatened that he would be implicated in false cases, if he failed to do so. The allegation of the petitioner that a police constable was sent to his house and he was asked to come to the police station for settling the dispute was also denied. According to the Sub Inspector, the police authorities never harassed the petitioner or abused him or threatened him.
The aforestated stand of the police authorities, as set out in the counter affidavit, is taken on record. In the light thereof, no adjudication is warranted on merits in this case.
Sri Naga Praveen Vankayalapati, learned counsel for the petitioner, is also agreeable for closure of this case recording the stand of the police authorities.
The writ petition is accordingly closed.
Pending Miscellaneous Petitions shall also stand closed. No order as to costs.
