THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.9616 of 2016 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief: "to issue writ of Mandamus to declare the action of the respondent in passing the impugned order vide No.02/95(32)/2015-MSRD-I, dated 05-02-2016 levying the charge against the petitioner wherein the annual increment of the petitioner has been deferred for a period of six (6) months as arbitrary, illegal and thereby issue order, direction or writ more particularly one in the nature of Writ of Mandamus and to consequently direct the respondents to suspend the impugned order vide No.02/95(32)/2015-MSRD-I, dated 05-02-2016."
Heard, Smt.Trupthi Agarwal, learned counsel for the petitioner and Sri N. Vasudeva Reddy, learned Standing Counsel for respondents.
The petitioner herein is a bus Conductor in the respondent corporation. By virtue of the impugned final order, dated 05-022016 the Depot Manager, Musheerabad Depot-I, T.S.R.T.C., Hyderabad - 3rd respondent herein inflicted on the petitioner the punishment of deferment of annual increment for a period of six (6) months without any affect on the future increments. During the course of hearing, it is submitted by learned Standing Counsel for respondents that the questioned order is appealable and appeal lies to the Deputy Chief Traffic Manager and without exhausting the said alternative remedy the present
writ petition is filed.
In view of the same and in view of the availability of alternative remedy of appeal, this Court is not inclined to meddle with the impugned order passed by the 3rd respondent. For the aforesaid reasons, the writ petition is dismissed, with a liberty to the petitioner to avail the alternative remedy of appeal available to her.
Miscellaneous Petitions pending, if any, shall stand closed. There shall be no order as to costs.
