ORDER:-

The grievance of the petitioner in this case was that the respondent authority was refusing to correct her date of birth from 29.05.1991 to 29.05.1990 and also correct her father's name as Mohammed Siddiq instead of Mohammed Siddiq Nayeem in her Secondary School Certificate. According to the petitioner, her birth certificate reflected the aforestated details correctly but wrong entries were made in the Secondary School Certificate.

2. Learned Government Pleader for Education fairly sated that applications for corrections in the Secondary School Certificate by the authority would be permissible within three years from the date of completion of the course. However, she points out that there is a procedure prescribed in this regard and that the petitioner has not abided thereby.

3. In the present case, the petitioner passed Secondary School Certificate course in May, 2010. She filed this writ petition in April 2011. Therefore, the complaint as regards corrections to be made in the Secondary School Certificate records was made well before the expiry of three years. However, as rightly pointed out by the learned Government Pleader, the petitioner did not choose to follow the prescribed procedure while seeking reddressal of her grievance.

It would therefore be necessary for her to do so atleast at this stage.

The writ petition is therefore disposed of permitting the petitioner to make an application to Royal Emassy High School at Santoshnagar, Hyderabad, where she pursued her Secondary School Certificate course, seeking correction of her Secondary School Certificate by incorporating her correct date of birth and substituting her father's name. She shall support such application with all necessary documentation. In the event such application is found to be in order, the said School shall forward the same to the Board of Secondary Education, Telangana, Hyderabad, which shall consider the same in accordance with law and take appropriate action thereon.

Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs. _______________ SANJAY KUMAR, J July 23, 2015 Lmv
