HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.16391 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The Writ Petition is being disposed of at the stage of admission with the consent of parties. The petitioner was appointed as a fair price shop dealer of shop No.9, Morjampadu Village, Machavaram Mandal, Guntur District. Proceedings dated 04.09.2014 were initiated suspending the authorization of the petitioner for variation in stock. But, however, after filing of W.P.No.34808 of 2014, the authorization of the petitioner was restored and proceedings dated 18.11.2014 were issued withdrawing the proceedings dated 04.09.2014. Thereafter, stock was supplied to the petitioner from December, 2014 to April, 2015.

The petitioner's grievance is that, though she deposited the required amount by way of demand draft for supply of stock, the stock was not released. Hence the Writ Petition. Time was granted to the learned Government Pleader for Civil Supplies to obtain instructions. Today, learned Government Pleader, on instructions, submits that on 28.04.2015, some variation in stock was noticed and, disciplinary proceedings were initiated against the petitioner and 6A proceedings are also pending against her.

In the circumstances, the Writ Petition is disposed of directing the second respondent to release the stock to the petitioner so long as the authorization of the petitioner is valid and is in force.

Miscellaneous petitions, if any, pending in this writ petition shall stand disposed of. No order as to costs.
