HON'BLE Smt. JUSTICE ANIS Criminal Petition No.14184 of 2016 ORDER:
This Criminal Petition is filed by petitioner, under Section 482 Cr.P.C, seeking quashing of investigation in Crime No.544 of 2016 of Jubilee Hills Police Station, Hyderabad, registered for the offences punishable under Sections 420, 468, 471, 427 read with Section 34 I.P.C. and Section 5 of A.P.Land Grabbing Act, 1982.
The 2nd Respondent - de facto-complainant contended that on the advice of the petitioner-A6, who is an Advocate, all the accused hatched a plan to get the subject land registered on 23-08-2016, got registered 600 sq. yards of land in favour of A2 and A3.
Learned Counsel appearing for the petitioner contends that the petitioner has not committed any offence and he is innocent. On the other hand, learned Additional Public Prosecutor opposed the Criminal Petition contending that, since the investigation is still going on, the question of quashing investigation does not arise. In view of the facts and circumstances of the case, this Court is not inclined to interfere with investigation. However, the Station House Officer, Jubilee Hills Police Station, Hyderabad, is hereby directed not to arrest the petitioner - A6 in Crime No.544 of 2016 till completion of investigation or, filing of charge sheet or final report.
With the above direction, the Criminal Petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
