THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 24568 of 2019 O R D E R:

Petitioner asserts that she is the owner of house property bearing No.19-1-40/5, admeasuring 242 square yards in Survey No.170PP situated at Budakalan Sivar, Bellampally Basthi, Bellampally, Mancherial District. Her grievance is that without any notice, respondent No.2 is interfering with her peaceful possession and enjoyment of the above said property. Hence, she filed this writ petition.

Heard learned counsel for the petitioner.

Learned Standing Counsel for Bellampally Municipality appearing for respondent No.2 submits that the allegation of the petitioner that the respondent authorities are interfering with her peaceful possession and enjoyment over the subject property is false, however, if the land is required for any public purpose, the respondent authorities would follow due procedure. Recording the above said submission, the writ petition is disposed of. It is made clear that if the petitioner is in possession of the subject property, her eviction shall not be made without following due procedure.

Miscellaneous Petitions, if any pending, shall stand disposed of. There shall be no order as to costs.
