The case of the petitioner is that his grand father, viz., Peer Baksha has three children. After the death of his grandfather and the father of the petitioner, respondents 3 to 6, who are the family members of Mahaboob Ali-the 2nd son of late Peer Baksha, got mutated the land admeasuring Ac.147.00 in Sy.Nos.403, 404, 405 and 651 situated at Tandur Village and Mandal by misleading the fact before the revenue authorities regarding the other legal heirs of Peer Baksha, without following the procedure prescribed under the Rights in Land and Pattadar Passbooks Act,
1971 (for short 'the Act'). Though the petitioner filed a representation dated 22.12.2014 before the 2nd respondent-Sub-Collector & Sub Divisional Magistrate, Asifabad, Adilabad District, seeking cancellation of illegal mutation made in favour of respondents 3 to 6, the same has not been disposed of. Hence the petitioner filed the present writ petition.
Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue (Telangana) for respondents. The relief sought by the petitioner cannot be granted in this writ petition because of lack of details with regard to the application made by respondents 3 to 6 and the subsequent order of mutation in their favour. If the petitioner is aggrieved by the mutation made in favour of respondents 3 to 6, he has an alternative remedy provided under the Act.
In that view of the matter, this writ petition is disposed of with liberty to the petitioner to avail the alternative remedy available to him under the Act. No costs. As a sequel, miscellaneous petitions, if any, shall stand closed. _____________________ CHALLA KODANDA RAM, J.
