HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.21338 of 2018 ORDER:
Heard learned counsel for petitioners and the Assistant Government Pleader for Revenue.
The petitioners pray for a Mandamus seeking execution of communication of 2nd respondent, dated 18.10.2017. The substantive grievance of petitioners is that the 5th respondent-Tahsildar is not mutating the name of petitioner in the revenue records and issuing pattadar passbook/ title deed for an extent of Ac .13.24 gts., in Sy.Nos.114, 115, 121, 122, 123, 136 and 140 at Patancheruvu Village and Mandal, Sanga Reddy District. This Court is compelled to remark that Article 226 cannot be in normal circumstances invoked as an executing court for the letters issued by the authorities. Secondly, the petitioner ought to apply as provided by the Act and Rules, insist upon timely compliance of the request and the inaction continues, thereafter, for justifiable reasons, remedy under Article 226 can be invoked. At this stage and for the reasons recorded above, this Court does not want to entertain the writ petition, but gives liberty to petitioner to apply and work out remedies in accordance with law.
With the above observation, the writ petition is dismissed. No order as to costs.
