COMMON ORDER: (Per Hon'ble Sri Justice C.V.Nagarjuna Reddy) Since both these writ petitions relate to common subject matter, they are heard and being disposed of together. W.P.No.37236 of 2015 is filed by the auction purchaser for a mandamus to set aside order dated 27.10.2015 in S.A.No.332 of 2014 of respondent No.4.

W.P.No.40595 of 2015 is filed by the owner and mortgager of the property to respondent No.1 for a mandamus to set aside letter dated 09.12.2015 of respondent No.1.

These two writ petitions came before us on more than one occasion. The cases were adjourned at the request of the learned counsel for the parties for an out of Court settlement. At the hearing, learned counsel for the petitioner in W.P.No.37236 of 2015 submitted that in view of understanding reached between his client and the petitioner in W.P.No.40595 of 2015, his client is not interested in pursuing this Writ Petition.

As regards W.P.No.40595 of 2015, Sri A. Sudershan Reddy, learned Senior Counsel appearing for the petitioner, submitted that since his client has deposited the entire amount including interest as directed by the Debts Recovery Tribunal, Visakhapatnam, the cause in this writ petition does not survive for adjudication.

In the light of the submissions of the learned counsel for both parties, the writ petitions are disposed of as adjudication on merits has become unnecessary.

As a sequel, WPMP.No.47938 of 2015 in W.P.No.37236 of 2015 and WPMP.Nos.26430 of 2016 and 52427 of 2015 in W.P.No.40595 of 2015 stand disposed of as infructuous.
