The Court made the following:
ORDER:
The interim order granted on 30.10.2014 in W.P.No.35222 of 2014 in W.P.No.28142 of 2014 was as in terms of the prayer sought in the petition. The prayer sought was to forthwith receive and register the document presented by
the petitioners in respect of the house site admeasuring 271.08 square yards in Survey No.526, situated at Dhone Village and Mandal, 7th Ward within Dhone Municipality, Kurnool District.
2. Alleging that the order is violated, this contempt case is filed.
3. Learned counsel for the petitioners submitted that concerning the said property, two separate documents were presented, one on 06.11.2014 to an extent of 96.02 square yards and another document on 10.12.2014 to the remaining extent.
4. As per the instructions furnished to the learned Government Pleader, the document presented was assigned P.No.20 of 2014. The document was registered on 06.02.2014 and returned to the party on the same day.
5. Even according to the learned counsel for the petitioners, there is no proof of presentation of the second document and no P number is assigned. More over, strictly going by the orders of the Court, the direction applies to the documents which were already presented, but apparently by the time interim orders were passed, no document was presented. Therefore, I see no reason to proceed further in the contempt case.
6. The Contempt Case is, accordingly, closed. It is always open to the petitioners to work out their remedies with reference to the alienation of their properties in accordance with law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
