THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9862 OF 2016 ORDER:
This Criminal Petition is filed by the petitioner/A-6 under Section 438 Cr.P.C. seeking anticipatory bail in Crime No.94 of 2015 on the file of Udayagiri Police Station, S.P.S.R. Nellore District, registered for the offences punishable under Sections 379 and 489 I.P.C. and Sections 29(i) (ii) of the A.P. Forest Act, 1967.
2. Heard and perused the material available on record.
3. The allegation against the petitioner is that on 27.12.2015, in between 7:00 and 8:00 hours, near forest area of BC Colony of Kurrapalli Village, he along with other accused was transporting red sandal logs illegally to Chennai and he was also in possession of counterfeit currency notes.
4. Learned counsel for the petitioner submitted that the petitioner is innocent of the offences alleged against him and he has been falsely implicated in the present case; that the petitioner will cooperate with the investigation and will not flee from the hands of police.
5. Learned Additional Public Prosecutor opposed to grant bail to the petitioner.
6. Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner.
7. Accordingly, the Criminal Petition is dismissed. _________________________
