THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8824 OF 2023 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/Accused in Crl.M.P.No.3132 of 2023 in Crime.No.208 of 2023 on the file of Saidabad Police Station, Hyderabad, registered for the offences under Sections 302 and 202 of IPC. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State and perused the record.

The petitioner is being tried for the offence under Section 302 and 202 of IPC. The allegation of the prosecution is that the petitioner has strangulated his wife as she did not cooperate for sexual intercourse, after delivery of their 2nd baby.

On instructions, learned Additional Public Prosecutor would submit that the charge sheet is already filed having completed the investigation.

In the said circumstances, the petitioner can be granted regular bail, subject to following conditions: i) The petitioner/Accused shall execute personal bond for a sum of Rs.25,000/- (Rupees Twenty five thousand only) with two sureties, for a like sum each to the satisfaction of VII Additional Chief Metropolitan Magistrate, Hyderabad.

ii) The petitioner/Accused after release shall appear before the concerned Court as and when the case stands posted.

iii) The petitioner/Accused shall abide by the other conditions stipulated under Section 437(3) of Cr.P.C.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, pending if any, shall stand closed.
