THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.25393 of 2017 ORDER:

Heard the learned Counsel for the petitioner and the learned Government Pleader for respondent Nos.1 to 3. The petitioner claims to be a resident of Eluru and he used to maintain fish tanks in and around Eluru by taking them on lease. He participated in the open auction conducted by the fourth respondent for leasehold rights of fish tanks situated in the fourth respondent Village for Fasli 1424 to 1426 held on 30.07.2014. He was declared as the highest bidder for an amount of Rs.62,60,000/- and the lease period expired by 31.07.2017. He states that there are totally five tanks in the Village in an extent of Acs.50.00. Now he states that he invested huge amount and if a fresh auction is held by the fourth respondent, he would suffer serious loss. He seeks extension of his lease, for which purpose he submitted a representation on 12.03.

2015 to the fourth respondent followed by another representation on 24.02.2016. He states that he never committed default in payment of lease amount. He also submitted three representations followed by the latest representation on 26.07.2017. When no reply was received, the present Writ Petition is filed.

In view of expiry of the period of lease, this Court cannot entertain the present Writ Petition. But, it is for the fourth

respondent to consider the representation submitted by the petitioner and take action in accordance with law. Hence, without expressing any opinion on the merits of the case, this Writ Petition is disposed of directing the fourth respondent to take necessary action on the representation submitted by the petitioner and communicate the decision to the petitioner, within a period of fifteen days from the date of receipt of a copy of this order. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
