THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 18118 of 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for the respondents.

2. The petitioner is a proprietor and contractor of M/s. Gouri Shankar Par Boiled Ind., situated at Kodad, Nalgonda District. While so, a surprise check was conducted by the officials on the mill on 15.05.2015 and on noticing certain irregularities, 6A proceedings were initiated, a panchnama was conducted and the stock was seized. The petitioner submitted a representation on 18.05.2015 for release of the seized stock, but no orders were passed thereon. In those circumstances, the present writ petition is filed.

3. The petitioner is not willing to furnish any security to the seized stock for its release. However, the petitioner prays for early disposal of the 6A proceedings pending before the 2nd respondent. In the circumstances, the writ petition is disposed of, directing the 2nd respondent to conduct an enquiry in respect of the 6A proceedings initiated against the petitioner and complete the same within a period of three months from the date of receipt of a copy of the order. Till such time, the seized stock shall not be sold or entrusted to any dealer.

4. Accordingly, the Writ Petition is disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs.
