THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.9984 of 2025 ORAL ORDER:
Seeking the Court to enlarge the petitioner-accused No.8 in Crime No.79 of 2025 of Doulthabad Police Station, Vikarabad District, registered for the offences punishable under Sections 103(1), 118(1), 126(2) r/w 3(5) of Bharatiya Nyaya Sanhita (for short 'BNS'), on bail, the present Criminal Petition is filed.

The brief facts of the case are that, on 30.06.2025, the de-facto complainant lodged a complaint stating that he has four brothers and four sisters. Among them, his younger brother was the youngest son of their parents. Their family owns 5 acres of agricultural land in Sy.No.55 of their Thanda. On 29.06.2025, when they were proceeding to their agricultural lands using the regular pathway through the lands of one Dhanavath Vijay Naik of Hanmya Naik Thanda, they noticed that the said Vijay Naik had blocked the passage using a JCB. When they questioned him, a quarrel ensued, and they were assaulted by Dhanavath Vijay Naik and his
associates. Later that night, while the complainant along with his brother, his son, his elder son, and nephew were returning to their Thanda on two motorcycles near Hanmya Naik Thanda, a group of individuals allegedly attacked them with iron rods and sticks. As a result of the attack, the complainant sustained injuries, and his brother, Venkat Naik, suffered grievous head injuries and later succumbed to them while being taken to Hyderabad for better treatment. 3.
Basing on the said complaint, the police registered a case against the accused vide Crime No.79 of 2025 for the above said offences.

Heard Sri M. Anil Kumar, learned counsel appearing on behalf of the petitioner as well as Sri Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for respondent - State.

Learned counsel for the petitioner submitted that the petitioner is an old woman aged about 70 years suffering from diabetes, blood pressure, and vision impairment and she is innocent and has not committed any offence, and that he has been falsely implicated in the present case. He further
submitted that the petitioner was arrested on 01.07.2025, and that the material part of the investigation has been completed, including the examination of fourteen witnesses. Therefore, he prayed the Court to grant bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner by contending that the allegations against the petitioner were serious in nature and that the investigation is in progress and if the petitioner is released on bail, at this stage, he may tamper with the evidence and may threaten the witnesses. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and a perusal of the material available on record, it is observed that the petitioner is in jail from 01.07.2025 and as the material part of the investigation is completed and considering the facts and circumstances of the case that she is aged about 70 years, this Court deems it fit to grant bail to the petitioner subject to the following conditions:
i.
The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class Court at Kodangal, Vikarabad District.
ii.
The petitioner shall appear before the concerned SHO at 11:00 A.M., on every Monday for a period of eight (8) weeks, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioner shall abide by the conditions stipulated in Section 483(3) of BNSS.

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
