THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.24438 OF 2011 ORDER:

When the matter is called, it is requested by the learned counsel appearing for the petitioner that the petitioner herein may be permitted to file Statutory Appeal before the Appellate Authority under the provisions of Section 89 of the Education Act, 1982. The said request is not opposed by the learned Government Pleader.

In view of the same, Writ Petition stands disposed of, permitting the petitioner herein to file Statutory Appeal under the provisions of Section 89 of the Education Act, against the orders of the 4th respondent vide proceedings Lr.R.C.No.4474/B3/2010, dated 13.07.2011, within a period of four weeks from the date of receipt of a copy of this order. If any such Appeal is filed, the same be considered and appropriate orders be passed on merits, after giving notice and opportunity of being heard to the petitioner, within a period of three months thereafter.

Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs.
