THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 24554 of 2019 O R D E R:

This Writ Petition is filed for the following relief: "....to issue a Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not demolishing the illegal constructions made by the unofficial respondent Nos. 5 to 17 without obtaining any permission from the official respondents in the petitioner's land to an extent of Acs.2.15 guntas in Sy.No.965/B situated at Hanmakonda Revenue Village, Warangal Urban District and without considering the representation dated 26.09.2019 of the petitioner by not considering the Injunction Order passed in IA No. 240/2013 in OS No.170/2013 dated 12.03.2013 on the file of Principal Senior Civil Judge, Warangal and also not considered the application No.CP.13507/2013 dated 02.04.

2013 is illegal, arbitrary and against the principles of natural justice and also violative of the Articles 14, 19, 21 and 300A of the Constitution of India and consequently, direct respondent Nos. 1 to 4 to demolish the illegal constructions made by the unofficial respondents immediately in the petitioner's land ...."

Heard learned counsel for the petitioner and learned Standing Counsel for the Greater Warangal Municipal Corporation appearing for respondent Nos.2 to 4.

As it is stated that O.S.No.170 of 2013 on the file of Principal Senior Civil Judge, Warangal is pending, the petitioner is required to

seek remedies in the pending suit or avail any other remedy that may be available to her.

In view of the above, the writ petition is closed. Miscellaneous Petitions, if any pending, shall stand closed. There shall be no order as to costs.
