HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 21723 OF 2004 ORDER :

This Writ Petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not extending the benefit of G.O.Ms.No.208, dated 29.6.1999 as arbitrary, illegal and sought a consequential direction to the respondents to give service weightage of 3 years to the petitioner for the purpose of pensionary benefits. Heard Smt. K.Sesharajyam, the learned counsel for the petitioner and the learned Standing Counsel for the respondents. It has been contended by the counsel for the petitioner that the petitioner has rendered 29 years of service with the respondents. But the respondents are not extending the benefit of G.O.Ms.No.208, dated 29.6.1999 to the petitioner and not extending service weightage of 3 years for the purpose of pensionary benefits.

This Court, having considered the submissions made by the learned counsel for the parties, is of the considered view that this writ petition can be disposed of directing the petitioner to make a fresh representation to the respondents within two weeks from the date of receipt of a copy of this order and upon such representation being received, the respondents shall consider and pass appropriate orders in accordance with law. With this observation, the Writ Petition is disposed of.
