THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 17428 of 2015 ORDER:
Heard learned counsel for the petitioner and learned Government Pleader for the respondents.
2. The petitioner was appointed as a Fair Price Shop Dealer of Shop No.11 of Gannavaram Village, Yaddanapudi Mandal, Prakasam District. While so, on 10.09.2014, the Enforcement Deputy Tahsildar, Parchur, Prakasam District, inspected the shop and conducted a panchnama and seized the entire ground stock. Pursuant to the said action, 6-A proceedings were initiated. He submitted a report to the 3rd respondent, who on receipt of the same, suspended the authorization of the petitioner pending enquiry by proceedings dated 24.09.2014. Challenging the same, the present writ petition is filed. The petitioner was also issued a show cause notice on 24.09.2014 itself and he submitted his explanation on 31.10.2014. The enquiry has not yet been completed by the 3rd respondent.
3. The learned counsel for the petitioner submits that in view of the delay in completing the enquiry, the petitioner is entitled for restoration of his dealership. The learned counsel also submits that though the petitioner submitted a petition on 05.06.2015, the enquiry is not completed.
4. In the circumstances, the writ petition is disposed of, directing the 3rd respondent to complete the enquiry pursuant to the show cause notice dated 24.09.2014 within a period of 30 days from the date of receipt of a copy of the order and pass final orders after observing the principles of natural justice.
5. The Writ Petition is accordingly disposed of. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. There shall be no order as to costs.
