THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.25720 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the action of the respondents herein in not considering the petitioner representation dated 20.6.2015 pertaining to renewal of the D.B.B.L.Gun Licence No.125/1-RZL for a further period from 1.1.2015 to 31.12.2017 as illegal, arbitrary,and contrary to the principles of natural justice and consequently direct the respodnents to consider thepetitioner representation dated 20.6.2015."

Heard Sri N. Anula, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court. According to the petitioner, petitioner herein submitted an application before the District Collector, East Godavari, Kakinada - 2nd respondent herein for gun licence on 20-02-2015 and subsequently submitted a representation also on 20-06-2015. Learned counsel for the petitioner submitted that no orders have been passed on the said applications said to have been submitted by the petitioner herein.

Since the said representation, according to the petitioner, is pending consideration before the 2nd respondent herein, this Court deems it appropriate to direct the 2nd respondent - District Collector to pass appropriate orders on the applications submitted by the petitioner by fixing some time frame.

For the aforesaid reasons, the writ petition stands disposed of, directing the 2nd respondent - District Collector to take appropriate action on the application, dated 20-02-2015 and the representation, dated 20-06-2015 said to have been submitted by the petitioner herein for renewal of gun licence within a period of one month from the date of receipt of a copy of this order.
