HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No.19357 of 2015 ORDER:

Heard the learned counsel for the petitioner and the learned Government Pleader for Civil Supplies (TG). The petitioner is an agriculturist. He, along with 173 others, filed an application before the first respondent seeking release of 9,655 qtls. of soyabean seized on 19.05.2015, stored in Diamond Godown, Adilabad District, alleging that the stock was stored illegally in contravention of the Essential Commodities Act. The petitioner claims that, instead of considering the application, the authorities are trying to sell the seized stock through public auction. Hence the Writ Petition. Learned Government Pleader, on instructions, submits that the auction, which was scheduled to be held on 25.06.2015, was postponed.

In view of pendency of application of the petitioner and others for release of the seized stock, the first respondent is directed to consider the application and dispose of the same, as expeditiously as possible, within a period of thirty days from the date of receipt of a copy of the order. Till then, the stock seized shall not be sold in public auction.

The Writ Petition is, accordingly, disposed of. As a sequel thereto, miscellaneous applications, if any, also stand disposed of. No order as to costs. _______________________________ A. RAMALINGESWARA RAO,J
