HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 34615 of 2013 ORDER:

This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the respondents in not settling the pension and death benefits pertaining to the husband of the petitioner late Sri Veeraiah, who worked in the 3rd respondent-college, and in not providing appointment on compassionate grounds, as illegal and arbitrary, and consequently, to direct the respondents to forthwith settle the pension and death benefits pertaining to the husband of the petitioner late Sri Veeraiah including the compassionate appointment.

Heard Sri Parsa Ananth Nageswar Rao, learned Counsel for the petitioner and the learned Government Pleader for Social Welfare for respondents Nos.1 to 3.

It has been contended by the petitioner that her husband was employed with the respondents and while he was in service, he died on 22.10.2008 and thereafter, she submitted an application seeking pensionary benefits and also to consider her case for appointment on compassionate grounds. 4.

The principal grievance of the petitioner is that the respondents neither released the pensionary benefits in favour

of the petitioner nor considered her case for compassionate appointment, and therefore, the present writ petition is filed. 5.

The learned Counsel for the petitioner contends that appropriate orders may be passed in favour of the petitioner directing the respondents to grant pensionary benefits of the husband of the petitioner and to consider the case of the petitioner for appointment on compassionate grounds. 6.

This Court having considered the said submissions made by the parties is of the view that this writ petition can be disposed of directing the respondents to consider the case of the petitioner for grant of pensionary benefits and compassionate appointment and pass appropriate orders. 7.

Accordingly, the Writ Petition is disposed of directing the respondents to consider the case of the petitioner for grant of pensionary benefits of her husband-late Sri Veeraiah, and also compassionate appointment, and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
