HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9092 of 2016 ORDER:

This Criminal Petition, under Section 438 of the Criminal Procedure Code, is filed by the petitioner-A1 seeking to grant anticipatory bail in CC No.297 of 2015 on the file of XIII Additional Chief Metropolitan Magistrate, Hyderabad, arising out of Crime No.16 of 2015 on the file of Women Police Station, DD, Hyderabad, registered for the offences punishable under Sections 498(A) and 406 IPC and 4 & 5 of the Dowry Prohibition Act.

Heard and perused the material available on record. The petitioner is the husband of the de facto complainant. The allegation against him is that he harassed the de facto complainant to bring additional dowry and also suspecting her character. Learned counsel for the petitioner submitted that the petitioner is innocent of the offences alleged against him and that the police, after completion of investigation filed charge sheet against the petitioner and other accused, showing the petitioner as absconding and the Court below issued NBW against the petitioner and that the petitioner is ready to appear before the Court below and to face the trial and he will not flee from the hands of justice and hence, he may be granted anticipatory bail.

Learned Additional Public Prosecutor opposed this application. Having heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and having perused the material available on record, this Court is inclined to pass the following order: The petitioner - accused No.1 is directed to surrender before the Court concerned and file a petition to recall the NBW issued against

him and on such petition being filed, the Court concerned is directed to recall the NBW on the same day on petitioner executing a bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for a like sum to its satisfaction, and further, the petitioner is directed to appear before the trial Court regularly on all hearing dates. Accordingly, the Criminal Petition is disposed of.

Consequently, the Miscellaneous Petitions pending, if any, shall stand closed.
