THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION NO.28423 OF 2015 ORDER:

The petitioner was appointed as Fair Price Shop Dealer of Shop No.16, Nandipadu village, Kolimigundla Mandal, Kurnool District. While so, the authorization of the petitioner was suspended pending enquiry in respect of minor variations noticed. It was also stated that the petitioner was not distributing the sugar since 5 years except March, 2015 and was distributing kerosene oil for only one day. Challenging the said order of suspension, the present writ petition is filed.

2. The order of suspension was passed on 30-04-2015 and the petitioner is said to have submitted his explanation on 19-05-2015.

In the normal circumstances, in view of nature of allegations, this Court would have interfered with the said order as the variations are found to be very marginal and other allegations are technical in nature. But, in view of temporary arrangements that might have been made consequent to the orders of suspension, this Court is not inclined to interfere with the enquiry process at this stage. In the circumstances, the 2nd respondent is directed to conduct an enquiry in respect of the allegations made and complete the same by giving due opportunity to the petitioner within a period of 30 days from the date of receipt of a copy of this order.

3. Accordingly, the writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
