HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Contempt Case No. 1413 of 2015 Order:

This Contempt Case is filed alleging non-implementation of the order, dated 23.12.2014, passed by this Court in WP No.3922 of 2007.

2. This Court, while setting aside the order, dated 20.10.2003, in the Writ Petition, directed the respondents to reconsider the matter in the light of the representation submitted by the petitioner on 30.12.2006 keeping in view the provisions of the Act 22 of 1988 and GO Ms. No.143, dated 16.12.2003, and pass appropriate orders in accordance with law within a period of six months from the date of receipt of the order.

3. After many adjournments, an order was passed on 25.02.2016 rejecting the request of the petitioner keeping in view the provisions of the Act 22 of 1988 and also GO Ms. No.143, dated 16.12.2003.

4. Learned counsel for the petitioner submits that mere mentioning of the consideration of the said Government Order and the provisions of the Act is not a sufficient compliance of the orders passed by this Court. But, a perusal of the order dated 25.02.2016 shows the application of mind to the facts of the case, though not in the sense of the direction issued by this Court. Since the proceedings under Contempt of Courts Act have their own limitations, this Court is not inclined to examine the merits of the decision taken on 25.02.2016, but it is open to the petitioner to agitate his rights according to law.

5. The Contempt Case is, accordingly, closed. There shall be no order as to costs.

6. As a sequel thereto, the miscellaneous applications, if any,

pending in this Contempt Case shall stand closed. ________________________ A.
