HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL REVISION CASE No.993 of 2017 ORDER :
Aggrieved by the dismissal order dated 04.03.2017 in Crl.MP.No.10337 of 2016 in C.C.No.440 of 2016 passed by the Judicial Magistrate of I Class, Special Mobile Court, Eluru, which was filed under Section 91(2) Cr.P.C. to produce the documents in possession of the complainant, this revision is filed by the petitioner/ accused. Heard before admission and notice to respondent No.2. The impugned order, in fact, no way requires interference, that too, when trial not even commenced, it is for the complainant once the accused wanted to dispute in support of the defence that the cheque is not issued for any alleged amount but for at the inception of starting of credit transaction, a blank cheque obtained and it is misused and there is no credit amount with reference to the accounts, if at all due only it is from such cross examination of PW.
1 and from further proof required from the complainant, if any, in the course of any defence evidence such a requirement if at all to produce any bill books or ledger books of the relevant years can be considered. Subject to the above observations, the Criminal Revision Case is dismissed giving such liberty to future to revive such request already made.
