HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.38626 OF 2016 ORDER:

The present writ petition is filed by the petitioner seeking to call for the records pertaining to FIR No.149 of 2016, on the file of Inaguduru Police Station, Krishna District, and quash the same. Heard and perused the material available on record. The petitioner is running a private chit business. The 3rd respondent subscribed a chit of Rs.1,00,000/ -. The allegation against the petitioner is that even after completion of the period, the petitioner is not paying the chit amount to the 3rd respondent. The grievance of the petitioner is that the petitioner never intends to cheat the 3rd respondent and that the matter is in civil nature and that with false allegations, the present case is registered against her and that being a lady, she apprehends arrest in the hands of police.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the 2nd respondent is directed to complete the investigation in the above crime, and file a final report, in accordance with law in either way, without arresting the petitioner. The petitioner is also directed to appear before the investigating agency and execute a personal bond for a sum of Rs.5,000/ - (Rupees five thousand only) with one surety for the like sum for her appearance before the investigating agency as and when required, for the purpose of investigation.

With the above directions, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
