THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.22950 of 2015 ORDER:

The petitioner was appointed as a permanent fair price shop dealer of shop No.29, Pandikona village, Pathikonda Mandal, Kurnool District. While so, on 06.12.2014, a show cause notice was issued to the petitioner alleging that she was not residing in the village and her

father was running the shop. The petitioner submitted her explanation on 18.12.2014. After receiving the explanation, the 3rd respondent passed an order on 05.01.2015 cancelling the authorization of the petitioner. Against the same, the petitioner preferred an appeal before the 2nd respondent on 21.01.2015 and when the said appeal was not disposed of by the 2nd respondent, the present writ petition is filed. The learned Government Pleader, on the basis of the instructions, submits that the appeal is pending with the 2nd respondent.

In view of the pendency of the appeal before the 2nd respondent since January, 2015, the 2nd respondent is directed to consider the appeal and pass final orders, within a period of thirty days from the date of receipt of a copy of this order, by duly giving opportunity of hearing to the petitioner.

Accordingly, this writ petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any pending in this writ petition, shall stand closed.
