ORDER:

This Writ Petition is filed for a Mandamus to declare the action of the respondents in seeking to increase the FTL of Dharmasamudram Tank situated within the Village limits of Turkapally Village, Mahabubnagar District as illegal and arbitrary.

At the hearing, the learned Assistant Government Pleader for Irrigation and Command Area Development

(Telangana State), on instructions, submitted that due to delay in commencement of the work, the contractor has withdrawn from the contract by taking back the Earnest Money Deposit and that at present, the official respondents are not proposing to proceed with the proposed work of increase of FTL of the abovementioned tank. In the light of the above submission of the learned Assistant Government Pleader, the Writ Petition is disposed of with liberty to the petitioner to avail a fresh remedy in the event, the official respondents seek to proceed with the work of increase of FTL of Dharmasamudram tank in future.

As a sequel to disposal of the Writ Petition, WPMP.No.5785 of 2012 filed by the petitioner for interim relief is disposed of as infructuous.
