HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9639 OF 2015 ORDER:

This Criminal Petition is filed by the petitioner/A1 under Section 482 Cr.P.C seeking to quash the proceedings in C.C.No.405 of 2014 on the file of XIII Additional Chief Metropolitan Magistrate, Mahila Court, Hyderabad, where the learned Magistrate has taken cognizance for the offence punishable under Sections 498-A and 406 I.P.C. and 4 and 6 of the Dowry Prohibition Act, which is outcome of the report of the 2nd respondent in Crime No.263 of 2013 dated 12.07.2013 , from which the police after investigation filed the final report for the offences supra.

Heard the learned counsel for the petitioner and the learned Public Prosecutor for the State before notice to respondent No.2 and before admission. Perused the material on record.

It is the submission of the learned counsel for the petitioner that the petitioner is an Australian citizen and he is facing the ordeal being held up in India because of the case that is affecting his growth, source and avocation and the case is required earlier disposal. As it is the letter and spirit of Section 309 Cr.P.C. to conduct trial day to day; needless to hear the de facto complainant in this regard, this application is disposed of at the stage of admission directing the learned Magistrate concerned, if charges not framed so far, to complete the task of hearing and framing of charges within one week from the date of receipt of a copy of this order and complete the trial on day to day basis within three months from that date. If the trial is not completed within the aforesaid period for any just reasons, the learned Magistrate can file an application for extension of time by assigning reasons.

Accordingly, this criminal petition is disposed of. Miscellaneous petitions pending if any, shall stand closed.
