THE HONOURABLE SRI JUSTICE T.VINOD KUMAR WRIT PETITION NO.24597 OF 2019 ORDER:

The present Writ Petition is filed to declare the action of the respondents in not completing the investigation in Crime No.784 of 2019 of Cyber Crime Police Station, Hyderabad, dated 13.09.2019, as illegal and arbitrary and with a consequential relief to direct the respondents to complete the investigation into the said crime by arresting the accused and filing charge sheet as expeditiously as possible.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader, on written instructions dated 07.11.2019, would submit that based on the complaint made by the petitioner, a case was registered in Crime No.784 of 2019 and the second respondent took up the investigation in the matter. During the course of investigation, the investigating officer sent notices to Face Book authorities and obtained the suspected IP address details and also obtained the ownership particulars of the suspected IP logs of alleged Face Book profiles from the concerned service providers. It is also submitted that after analyzing all technical data and other credible information, the accused was apprehended on 20.09.2019, recorded his confessional statement and seized the incriminating material from his possession and sent the accused to judicial remand. Learned Assistant Government Pleader would further submit that the Investigating Officer, thereafter, sent the seized material i.e. mobile to the Telangana State Forensic Science

Laboratory (FSL) for analysis and after obtaining the FSL report and collecting the admissibility of electronic records as evidence from the concerned service providers in both cases, charge sheet would be filed before the Court concerned.

Having regard to the above said written instructions placed on record, it is felt that no further orders need be passed in this Writ Petition except observing that the authorities would complete the investigation and take appropriate action in the matter as expeditiously as possible.

With the above observation, the Writ Petition is closed. There shall be no order as to costs.

Miscellaneous applications, if any, pending shall stand closed.
