The present writ petition is filed questioning the action of the third respondent in calling the petitioners, who are wife and husband, to the police station.

Heard learned counsel for the petitioners and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 13.11.2019, a copy of which is placed on record of this Court, would submit that a case was registered against the petitioners in Crime No.716 of 2019 for the offence under Sections 447 and 427 of IPC on the file of Medipally Police Station. During the course of investigation of the above case and to serve a notice under Section 41-A of Cr.P.C. upon the accused persons, the police authorities have called the petitioners to the police station.

Learned counsel for the petitioners would submit that subsequently, the petitioners have received the notice under Section 41-A of Cr.P.C. and also filed their explanation. Learned counsel would further submit that there are, inter se, civil disputes between the petitioners and the fourth respondent herein and the police authorities cannot seek to interfere with the same, on the pretext of the crime being registered. 5.

Learned Assistant Government Pleader for Home, based on the above written instructions, would further submit that, except conducting investigation into the crime registered against the petitioners, the police

are not interfering into the civil disputes between the petitioners and the fourth respondent.

Recording the submissions made by the learned Assistant Government Pleader based on the written instructions that the police authorities never called the petitioners to the police station for settling the civil disputes between the petitioners and the fourth respondent, the writ petition is closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
