THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7028 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A2 in Crime No.43 of 2022 on the file of Central Crime Station DD, Hyderabad, registered for the offences punishable under Sections 406, 409, 420, 465, 467, 468, 471 read with 34 of Indian Penal Code.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of prosecution is that two companies by name M/s.Vogel Infra Private Limited represented by this petitioner and M/s.New Solutions represented by Accused Nos.1 and 4, filed tenders for execution of installing 368 solar water heaters. The said contract was executed at hostels as required by the Telangana State Education & Welfare Infrastructure Development Corporation ( for short 'TSEWIDC'). In the process of calling for tenders both the companies have filed tenders, however, the tender was granted in favour of M/s.New Solutions. During the

course of investigation, the police seized documents and found that both the New Solutions and Vogel Infra Private Limited have filed fabricated documents to support their claims for the purpose of getting contract. However, the contract was given in favour of M/s.New Solutions represented by A1 and A4.

Admittedly, as seen from the Remand Report, the contract was given to M/s.New Solutions and the allegation against this company is that they have filed false documents in support of their claim for contract. However, there is allegation in the Remand Report that the contract was partially executed by both Vogel Infra Private Limited and New Solutions. 5.

Keeping in view that contract was not granted in favour of this petitioner and all the documents which are alleged to have been fabricated are with the investigating agency, this petitioner can be granted the relief of bail subject to the following conditions: i) The petitioner/A2 shall execute personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) with two sureties for a like sum each to the satisfaction of XII Additional Chief Metropolitan Magistrate, Hyderabad at Nampally.

ii) The petitioner/A2, after release shall appear before the concerned Station House Officer, every Monday and

Thursday between 10.00 A.M. to 1.00 P.M. for a period of eight weeks, for the purpose of investigation. iii) The petitioner/A2 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

Miscellaneous applications, pending if any, shall stand closed.
