HCJ & AAR, J W.P. No.24610 of 2019 Dt: 11.11.2019 ORDER: (per the Hon'ble the Chief Justice Sri Raghvendra Singh Chauhan) The issue raised in the present writ petition with regard to the constitutional validity of Rule 5(2)(a)(i) of the Telangana State Judicial Service Rules, 2017, which imposes a requirement of three years of practice at the Bar upon a candidate, who is applying for the post of Junior Civil Judge, has already been decided by this Court in case of R. Anitha and others vs. the State of Telangana and others (W.P.No.23658 of 2019 and batch). In the said judgment, this Court has opined that the requirement imposed by the said Rule, and by the notification dated 08.03.2019, are contrary to the judgment of the Hon'ble Supreme Court in the case of All India Judges' Association and others vs. Union of India [(2002) 4 SCC 247].
Therefore, this case is squarely covered by the said decision of this Court. It is, hereby, allowed. There shall be no order as to costs.
As a sequel, miscellaneous petitions, pending if any, shall stand closed.
