HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 12562 of 2012 ORDER:

Heard learned counsel for the petitioners and Government Pleader for Revenue. With the consent of both the parties, the main writ petition is heard at the admission stage itself. The present writ petition came to be filed seeking issuance of writ of mandamus directing respondent No.1 to regularize the un-registered sale transaction dt. 06.09.1974 in respect of land admeasuring Ac.06.01 gts., situated in Sy.No.71 of Arli (B) Village and Mandal, Adilabad District, according to Section 5 A of the Andhra Pradesh Rights in Land and Pattadar Pass Book Act, 1971 and to issue pattadar pass books and title deeds to the petitioners in respect of the above land; and consequently declare the inaction of the respondents in not regularizing the same as illegal, arbitrary and violative of Articles 14 and 21 of the Constitution of India.

Though various grounds are raised in the writ petition, learned counsel for the petitioners submits that the petitioners made a representation dated 13.04.2012 seeking regularization of the sale transaction in respect of the said land and a direction may be given to dispose of the said representation at the earliest. The Government Pleader submits that if the said representation is still pending, a direction may be given to process the same in accordance with law.

Having regard to the circumstances stated above and without going into the merits of the case, the writ petition is

disposed of directing the first respondent to consider the representation dated 13.04.2012, if the same is still pending and pass orders in accordance with law within a period of twelve (12) weeks from the date of receipt of a copy of this order. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
