HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.6981 of 2015 ORDER:

The case of the petitioner is that he was declared as hereditary trustee by the 1st respondent vide proceedings dated 25.09.1993. Since he is functioning as hereditary trustee, he is entitled for declaration as a member of the founder's family by virtue of the Endowments Act, 17 of 1966. The petitioner from 1996 to 2003 had moving from pillar to post for adjudicating his claims as a member of the founder's family, which was not successful for the reason that hereditary rights were not recognized under the Act. The petitioner also unsuccessful in getting declaration as a member of the founder's family before the Endowments Tribunal in O.A.No.573 of 2010. The petitioner also filed C.M.A.No.590 of 2012 before this Court and the same was disposed of on 23.07.

2014 holding that once a person has been recognized as a hereditary trustee in respect of the institution established before the incorporation of the Act 30 of 1987, there is no need for him to once again approach the competent Authority seeking recognition as a member of the founder's family. Therefore, the petitioner made a representation on 19.11.2014 to the 1st respondent. As no orders are passed on the said representation, this writ petition is filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Endowments (Telangana). It is submitted by the learned Government Pleader for Endowments (Telangana) that the 1st respondent is going to take a decision on the representation of the petitioner.

Since the 1st respondent has to take a decision on the representation of the petitioner, I deem it appropriate to dispose of the writ petition, with a direction to the 1st respondent to consider the representation of the petitioner

within a period of four weeks from the date of receipt of a copy of this order. Accordingly, the Writ Petition is disposed of with the above direction. No costs.

Miscellaneous petitions pending, if any, in this Writ Petition shall stand closed.
