THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.9733 of 2015 ORDER:
The petitioner was appointed as a fair price shop dealer of shop No.36 of Cheekatigalapalem Village, Vinukonda Mandal in Guntur District. The authorization of the petitioner is valid as on today. While so, the shop was inspected on 09.03.2015 and some variation in the stock was found. Challenging the seizure of stock from the shop, the petitioner filed W.P.No.7313 of 2015, and after hearing the learned Government Pleader, an order was passed on 24.03.2015 directing the respondents to supply essential commodities to the petitioner. However, without supplying the commodities, a show cause notice was issued along with an order of suspension of authorization dated 20.03.2015. The petitioner submitted his explanation on 27.03.2015 to the charges leveled against him. Challenging the order of suspension, the present Writ Petition is filed.
It is clear from the above facts that the petitioner already submitted his explanation and the authorization of the petitioner was suspended in the month of March, 2015. Learned Counsel for the petitioner submits that no enquiry was conducted and no final orders have been passed in the case.
In the circumstances, this Court is not inclined to interfere with the enquiry process at this stage, but directs second respondent to complete the enquiry by giving due opportunity to the petitioner and pass final orders thereon, within a period of thirty days from the date of receipt of a copy of this order.
The Writ Petition is, accordingly, disposed of. The miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
