The Crl.P. M.P. Nos.10333 and 10335 of 2017 filed compounding the offences are dismissed because without presence of de facto complainant the Court is not inclined to consider the same though the defacto complainant is stated to be not a victim. So far as the merits of the case concerned, it is premature to make an expression but for from the defacto complainant shown as 1st respondent to the quash petition, who is a 3rd year B.Tech student and the petitioners claim that since the defacto complainant falsely laid the complaint, it is for her to approach the police to record her statement during investigation, if necessary, including under Section 164 Cr.P.C as it is prerogative. Accordingly, the Criminal Petition is disposed of leaving it open to the petitioners to avail all the defences available.
