ORDER

This petition under Section 482 Cr.P.C. is filed by the petitioner/accused seeking to quash the proceedings in Cr.No.88 of 2016 of II Town Police Station, Mahabubnagar, Mahabubnagar District, registered for the offence punishable under Section 3(1)( r)(s) of SCs & STs (POA) Act, against him.

2. It is alleged in the complaint that due to disputes with regard to the building construction, the accused, who is the President of TNGOs Association, came to the coaching centre on 06.04.2016 at 1230 hours, criminally trespassed into the coaching centre, damaged the articles and also necked out the students from the classrooms by abusing the complainant in filthy language in the name of his caste. Based on the complaint, the aforesaid crime was registered against the accused.

3. In view of the serious allegations made in the complaint, this Court is not inclined to interfere with the impugned proceedings. However, the concerned police are directed to complete the investigation without arresting the petitioner/accused and file a final report, if any, in accordance with law. The petitioner herein is directed to appear before the investigating agency as and when required and cooperate with the investigating agency.

4. With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this petition shall stand closed.
