HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION NO. 1208 OF 2016 ORDER:

This Writ Petition is with the following prayer: "For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue an order or direction more particularly on in the nature of Writ of Mandamus declaring the action of the respondents by demolishing the petitioner's compound wall and watchman room built up in admeasuring 600 sq.yds constructed in S.No. 199 in Moosapet, Kukatpally Municipality, Circle 14, Balanagar Mandal, Hyderabad without any notice and due process of law on Sunday 3.1.2016 at 9.00 AM onwards is contrary to the Municipal Laws is illegal, arbitrary and unconstitutional being violative of Art. 14 and 300-A of Constitution of India and consequently direct the respondent No.

4 not to interfere with peaceful possession and enjoyment of the petitioner's House property built up in admeasuring 600 Sq.yds and watchman room constructed in S.No. 199 in moosapet, Kukatpally Municipality, Circle 14, Balanagar Mandal, Hyderabad and pass such other order or orders may deem fit and proper in the circumstances of the case." At the time of admission, this Court grated interim direction not to interfere with the peaceful possession and enjoyment of the petitioner's property.

Learned Standing Counsel on instructions submits that the respondent Municipal Corporation is not interfering with the peaceful possession and enjoyment of the petitioner's property and if there is any necessity to interfere, they would follow the due process as required under GHMC Act.

In view of the said submission of the learned Standing Counsel, no further orders are necessary in this Writ Petition and accordingly, the Writ Petition is dismissed. There shall be no

order as to costs. As a sequel thereto, miscellaneous petitions, pending if any, shall stand closed.
