ORDER

This writ petition is filed seeking the following relief: "...to issue a writ, order or direction more particular one in the nature of Writ of Certiorari and after calling for the records in I.D.No.150/1997, dt 25.09.2000 on the file of the Hon'ble 1st respondent in so far as treating the period of suspension to till the date of reinstatement is not on duty and denying back wages to the petitioner is illegal, arbitrary and unjust and consequently quash the Award in I.D.No.150/1997, dt. 25.09.2000 by treating the period of suspension to till the date of reinstatement as on duty and grant back wages to the petitioner and pass such other order or orders as this Hon'ble Court may deems fit and proper under the circumstances of the case."

Learned counsel appearing for the petitioner submits that without appreciating any of the contentions raised by the petitioner, the Labour Court has denied the back wages and that while setting aside the order of removal, the Labour Court ought to have granted back wages to the petitioner by exercising its powers under Section 11-A of the Industrial Disputes Act, 1947.

Learned Standing Counsel appearing for the respondent-Corporation contends that there is no illegality or irregularity in the Award passed by the Labour Court and that

the Labour Court has rightly rejected the back wages to the petitioner.

Having considered the rival submissions made by the learned counsel on either side, this Court is of the view that when the petitioner has not pointed out any illegality or irregularity in the Award passed by the Labour Court, this Court is not inclined to interfere with the same. There are no merits in the writ petition and the same is liable to be dismissed.

Accordingly, the Writ Petition is dismissed. No costs. Miscellaneous petitions, if any, pending shall stand closed.
